Gemini Omni provides browser-based and account-based tools to generate, edit, preview, and export AI-assisted media and text. Features, models, resolutions, credit costs, and availability may change as we improve the product. We do not guarantee uninterrupted or error-free operation.

You are responsible for safeguarding your login credentials and for all activity under your account. You must provide accurate registration information and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or present security or abuse risk.

You agree not to: (a) use the Service to violate any law or third-party rights; (b) generate, upload, or distribute content that is illegal, defamatory, harassing, hateful, sexually exploitative of minors, or that promotes violence or self-harm; (c) attempt to reverse engineer, scrape, overload, or probe the Service except as permitted by law; (d) circumvent usage limits, billing, or access controls; (e) use outputs to mislead others into believing they were created by a human when disclosure is required by law or platform rules. We may enforce these rules by removing content, suspending access, or cooperating with authorities where required.

You retain rights in prompts, uploads, and other materials you submit (“User Content”), subject to applicable law. To operate and improve the Service, you grant Gemini Omni a non-exclusive, worldwide, royalty-free license to host, process, transmit, display, and create derivative works from User Content solely to provide, secure, debug, and improve the Service and to comply with law. You represent that you have the rights needed to submit User Content and that it does not infringe others’ rights.

AI-generated outputs may be unpredictable or similar to other users’ results. You are responsible for how you use outputs, including clearing rights for commercial distribution, likeness, trademarks, and music. We do not warrant that outputs are non-infringing or suitable for any particular purpose.

Paid plans, credits, and pricing are described at checkout and on our pricing page. Fees are non-refundable except as stated in our Refund Policy or where required by law. You are responsible for applicable taxes.

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Gemini Omni AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE PROHIBITED BY LAW.

You will defend, indemnify, and hold harmless Gemini Omni and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, risk to the Service or other users, or legal requirements. Provisions that by their nature should survive will survive termination.

These Terms, together with the Privacy Policy and Refund Policy where referenced, are the entire agreement between you and Gemini Omni regarding the Service. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
